UK Sponsors License
The UK work permit system has been replaced with a sponsor license system (as explained in previous emails). This requires forward planning because you need to get a license- without one you cannot bring anyone in- but there is good news: getting the license is straightforward and, once you have it, bringing directors and other key people into the UK for a commercials production is much simpler than under the old work permit system.
In preparing this guide we have had the benefit of the advice of Janice Leggett at Wollastons, Solicitors.
Employers have to get a sponsorship license to be able to sponsor a foreign worker to come to the UK. Employers/employees cannot apply for work permit: that system has been abolished. Instead, employers who anticipate they may want to bring people into the UK to work (who are not exempt from requiring to be sponsored- see below) must apply for a sponsors license. Once they have that, they can apply to bring people into work. The people they apply to bring into work must fall into one of the categories given .

and complete the application. You will need company details and some details of the person nominated as the point of contact but the application is straightforward. The application currently costs £400 and takes around 6 weeks to complete.
Once you have the sponsorship license, you be able to grant Certificates of Sponsorship for people you wish to bring to the UK to work.
You do not need to obtain a Certificate of Sponsorship in respect of:
1 Nationals of the E E A. These are the EU countries; Austria, Belgium, Denmark, Finland, France, Germany, Greece, Ireland, Italy, Luxembourg, Netherlands, Portugal, Spain, Sweden and the UK together with Norway, Liechtenstein and Iceland who are in the European Economic Area. Swiss Nationals are now included in this list, but there are slightly different rules for the new accession states including Poland, The Czech Republic, Bulgaria and Romania . Duel nationality, ie a US citizen who also has EEA nationality (perhaps through parental birth etc) will benefit.
2 Those who have permission under immigration rules, either through residency, marriage to a UK or EU citizen or are Commonwealth citizens with ancestry visas (these are available to Commonwealth citizens with a grandparent born in the UK).
You do not need a Certificate of Sponsorship either if the director or other grade is entitled to enter the UK as a business visitor- see below.
The holder of the sponsorship license (i.e the employer who holds the license) grants the Certificate of Sponsorship. The employer may grant a license to people who are defined as workers in a Senior Creative Grade. SCG includes Producer, Director and Director of Photography. For the full list, refer to the Home Office Guidance notes:
If the person the sponsorship license holder wants to bring in does not fall within the SCG category, there are other ways in which they can qualify: if you can show that the worker is needed for production continuity, if they fit the category of “Other key creative workers”, which requires a creative relationship with a SCG or a highly specialist role or you have advertised and failed to find anyone suitable for a role in the UK or the person is a personal assistant to a Director or Producer of International Status.
In practice, it will be the SCG which is the most use to APA members, as most of the people you seek to bring in will fall into that category. The grades that will not, such as production managers and pa’s, are likely to come within the definition of “Other key creative workers” provided they have an established relationship with the director/producer/director of photography.
The self certification will be policed. The issue of a certificate must be notified to the UK Border Agency, who then notify potentially interested parties, such as trade unions. The Home Office have also stated their intention to visit all licensed sponsors at some point during the 4 years in which the licence is valid. You may be asked for evidence that your were entitled to issue a CoS in respect of the worker, so you will need to show that and keep the appropriate records. If the worker is a SCG, that is straightforward and you will only need to show the worker is of the grade specified e.g that the director is an experienced director. A fee of £10 is payable each time you issue a CoS.
Business visitors
This is new too. Business visitors can enter the UK without a visa (they should identify themselves as business visitors, rather than tourists). As well as enabling people to enter the UK for meetings, the business visitor category now enables
“film crews on location shoots only, provided they are employed or paid by an overseas company;” to enter as business visitors- that is broader than the old location concession.
There is no definition of what a location is. Further, immigration officers at airports are not necessarily aware of it, so if you are planning to bring directors/crew to the UK because your production complies with the definition of who might be permitted to enter under the location concession, we suggest that the director/crew carry with them a copy of the explanation of the business visitor film location category, so they can show it to the immigration officer if necessary. They should also carry a letter from the foreign employer explaining what they will be doing in the UK and when they will be leaving.
Visas
One further point - which applies to both Business Visitors and those holding CoS; If the individual is a nationality which requires visas (e.g. India, China, South Africa), the individual will need to obtain a visa before travelling to the UK. They also need to have biometric data taken (fingerprints and photo). The whole process can take several weeks. Other nationalities such as USA and Canada do not require visas if the CoS is for less than 3 months or they are coming to the UK for less than 6 months as a Business Visitor.

Filming with Animals & Children
The APA recognises the need for production companies to observe Best Practice when dealing with Children and Animals and therefore advises members to peruse the relevant legislation below. Please note when looking at the “The Law on Filming with Children and forms for applying for a licence” document that some of the regulations have been amended so please also refer to “A simple guide to filming a commercial with children” which contains the amendments, with particular reference to hours at rehearsal and/or performance.
Training is another area where the Association is fully involved and gives its total support to both Skillset and Ft2 in the training of industry personnel.

The Young Directors Award is coming to Soho!
